The judge did not accept our defense's interpretation of the unfair 
nature of the contractual clause regarding Agripunk's obligations to 
provide costly asbestos roofing removal and other extraordinary maintenance.

This is because the Judge equated Agripunk's activity with "commercial," 
completely ignoring our status as a nonprofit organization and denying 
our status as a natural person "consumer," for which, in Supreme Court 
rulings, the unfairness clause applies.

Furthermore, the reasons for the interruption of some of our work were 
completely ignored: the first trial in 2019, the closures during the 
Covid period, the 2021 trial with the technical investigations and 
pressures that suspended a large portion of our activities, including 
the closures necessary to prevent the spread of swine fever, where it 
was also impossible to accept volunteers*, and the consequences of all 
this on our physical and mental health.

Agripunk Onlus, according to its bylaws, seeks to implement a 
transformation from a corporate to a social enterprise, experimenting 
with interspecies coexistence without any interest in profit. For this 
very reason, it succumbs to the industrial system of animal exploitation 
that views us as poor, deluded creatures who produce nothing.

Is the Isola refuge destined to become productive again for new 
businesses, new agritourism businesses, perhaps new livestock farms?

As we mentioned a few months ago, the farm is up for sale, and upon the 
expiration of December 31, 2025, Agripunk Onlus will have to move to 
where it will be located. We don't know what will happen to this place, 
or to us.

We are evaluating how to proceed with the lawyer Paterniti, whom we 
thank for his work so far, and we are also seeking your opinion.

Unfortunately, all the proposed solutions involve high costs and 
significant logistical difficulties.

It's not easy to stay, but neither is packing up and moving, also 
because a suitable place must first be found and, above all, care must 
be guaranteed for all the individuals who inhabit the refuge, as well as 
those who revolve around it and pass through it.

For this reason, we are once again involving our Municipality, the other 
affected Municipalities, and the Tuscany Region in our cause, to 
continue an activity recognized as essential for our community of people 
of various species, but above all to categorically prevent the reopening 
of any type of breeding facility here. We also ask for the help and 
support of the community that lives in this area and

has supported it for years, the local community, the associations, 
groups, collectives, and all the individuals who care about our 
existence, as well as the various organizations and institutions that 
have placed their trust in us and benefited from our social role of 
welcoming and caring.

refugees and the continued survival of this shelter.
