We experienced a fatal system failure ten days ago that severely crippled our efforts at keeping you informed of news and happenings regarding Headwaters Forest. Until this evening we had been unable to access this Update and Alert email list, and subsequently have been unable to send you our past two weeks' Updates and Alerts. We are now mostly back up and running, and this missive should be followed shortly by a new Update and new Alert for this week, as well as a digest of news you may have missed last week. FYI, we WERE able to continually update the website, even though the email list was down, so full versions of all the stories you may have missed are available at www.HeadwatersForest.org/news

STAFFORD RESIDENTS SUE MAXXAM/PACIFIC LUMBER
FOR MUDSLIDE PROPERTY DAMAGE
On December 2, 40 Humboldt County residents filed suit against Maxxam
for irresponsible timber practices and the threat to their safety posed by
mudslides and floods.
In two separate lawsuits, the property owners assert that Pacific
Lumber's clearcutting on the mountainside above Stafford caused the New
Year's Day mudslide that destroyed seven homes and caused the ongoing
flooding of the north fork of the Elk River earlier this year. The
plaintiffs also charge the company with defrauded the government and
residents in the Humboldt County town of Stafford and along the north fork
of the Elk River about the true extent of harm their tree-cutting
operations would cause.
"We are tired of hearing Hurwitz cry about his property rights. What
about us, the people who live here, and our rights?" asked Marilyn Del
Biaggio, a 72-year-old plaintiff and 41-year Stafford resident. Many of the
plaintiffs are Pacific Lumber employees, and some are third and fourth
generation Humboldt county residents.
The lawsuits are historically significant because they focus on
Maxxam's violations of property and personal rights, rather than
environmental regulations. Moreover, the suits assert that the company
engaged in unfair business practices and further, should be subject to
punitive damages for the harms it has caused. They also ask that Maxxam be
divested of any earnings proceeding from violations of the law.
Bob Irelan, Maxxam spokesman and chief propogandist, responded to the
suits by blaming the mudslides on the weather. "It appears that the
inordinate amount and intensity of the rain gave rise to the slide," said
Irelan. He also claimed that "in an effort of good will," Maxxam bought
some of the damaged properties and did reinforcement work on the land.
Maxxam's neighbors who have been forced into the courtroom for
compensation, however, considered the company's offer of $800 per acre for
their submerged homes to fall far short of neighborly "good will" or
corporate responsibility.

RELIGIOUS LEADERS ON THE RADIO
KCBS-AM in San Francisco ran a two-minute piece on the lawsuits
(mentioned above) and some of the moral issues being raised around
Headwaters. Rabbi Pearce of Congregation Emanu-El in San Francisco joined a
priest and a Buddhist leader in describing the spiritual significance of
ancient trees, and calling for the permanent preservation of all 60,000
acres of Headwaters Forest.

NATIONAL ORGANIZING UPDATE
Headwaters Sanctuary Project held a series of successful organizing
meetings on the east coast just prior to Thanksgiving. These meetings
provided the impetus for the formation of local Coalitions for Headwaters
in New York City, New Hampshire, Boston, and the Washington Area.
Members of groups including the Sierra Club, Rainforest Action
Network, the New Hampshire Greens, the Massachusetts Public Interest
Research group, and campus groups like Free the Planet! and SEAC are
helping to organize the coalitions, and collecting the "Pledge to Protect
Headwaters Forest."
These activists are ready to help us raise the profile of Headwaters
nationally by doing media and organizing demonstrations, writing letters to
the editor, forming a speakers bureau, and collecting pledges of support.
Many thanks to all the great Headwaters activists all over the
country who will be key players in our effort to propel this issue into the
national limelight, and to preserve the whole forest as a national treasure.

OPPOSE ROADBLOCKS TO SHAREHOLDER PROPOSALS
On January 2, the comment period closes on proposed securities rules
that would make it dramatically harder to sponsor shareholder proposals
like the Headwaters Forest proposal that the Rose Foundation sponsored last
May.
Under the current rules, shareholder resolutions have been more and
more effective in making companies change their treatment of natural
treasures like Headwaters Forest. Shareholder resolutions have been
important in a host of efforts, including the campaign to preserve the
Arctic Wildlife Refuge, the struggle to preserve forests near Clayoquot
Sound, and the campaign to reduce chlorine use and its impact on the human
and natural environment.
If adopted, these rules would put up major roadblocks for these kinds
of campaigns and would effectively make it impossible to wage a long-term
shareholder campaign like the South Africa divestment effort.

Dear Mr. Katz:
As a conservationist, I write to strongly oppose proposed changes in
the rules governing shareholder resolutions.
These changes would make it much harder to sponsor shareholder
proposals addressing environmental concerns. First, by increasing the
percentage of votes a resolution must win to be resubmitted, the new rules
would make it hard to build support over time. Second, the new rules would
allow company's to refuse to include a resolution on the proxy statement
if, in management's sole judgment, a resolution's sponsors are motivated by
a special interest, including, apparently, a special interest in the
environment.
From a purely financial standpoint, companies that improve
environmental performance tend to improve their stock performance as well.
If shareholders are not able to encourage companies to act as better
environmental stewards, it is not clear who will.
I urge you to withdraw the proposed rule changes.
