PEPPER SPRAY PRESS COVERAGE CONTINUES

The police pepper-spray attack on four peaceful Headwaters protesters continues to attract national press, with varying degrees of coverage for the issues hidden "behind the pepper spray curtain." A protest in front of Rep. Frank Riggs' office on Sunday generated some good coverage in the San Francisco Chronicle, reading: "Bay Area business executives and clergy yesterday demanded that Representative Riggs either apologize for his pepper-spray remarks or resign from office." For those who haven't been following this story, the protesters who were pepper-swabbed were chained to a tree stump they brought into Riggs' office. After the story was covered in the national news, Riggs defended the officers' actions on the floor of Congress, describing the protesters as "reckless, wanton lawbreakers." At the S.F. protest some protesters wore goggles in preparation for another pepper spray attack. The "San Francisco Comic Strip" in the Sunday Chronicle was a humorous parody of Riggs' office staff and Humboldt County law enforcement, featuring office workers cowering under their desks crying "No, please! Not a tree stump!" (Workers in Riggs' Humboldt County office have stated that they feared for their lives when the nonviolent protesters entered the building during October 16 protest, and that law enforcement acted properly when swabbing pepper spray on the locked-down protesters' eyes).

EVENT: RALLY AT S.F. FEDERAL BUILDING Friday, Nov 14, 10am (gather at 9:30am) Federal Building, 450 Golden Gate Blvd., San Francisco

There will be a rally outside the Federal Building in San Francisco this Friday in support of nonviolent protesters who were pepper-sprayed by Humboldt County Sheriffs in October. Inside, there will be a hearing on banning the use of pepper spray against activists in Humboldt County. The hearing starts at 10:30am and is open to the public. PACIFIC LUMBER READY TO LOG OLD-GROWTH GUARDED BY TREE-SITTERS

Humboldt County Sheriff deputies and Pacific Lumber personnel descended early this week upon tree sitters who were guarding a 154-acre area of residual ancient trees inside Headwaters Forest. This area protects a 2.5-mile stream adjacent to All Species Grove. The stream is critical habitat for the coho salmon, which requires cool, clear, free-flowing waterways. All Species is one of the six ancient groves of Headwaters Forest, and one of the four that would NOT be included in the proposed government acquisition (see bottom of this message for a full description of All Species Grove). Pacific Lumber's "Climber Dan" removed some of the tree sitters' gear and part of their platform, but the protesters remained upbeat and vowed to keep the "tree village" in place high in the canopy until all 60,000 acres of Headwaters Forest are permanently preserved.

ROSE FOUNDATION SEEKS MAXXAM SHAREHOLDERS TO SPONSOR RESOLUTION

After a successful campaign targeting the California State Teachers Retirement System, which sold its Maxxam stock this summer, the Rose Foundation is continuing to put pressure on other public and organizations holding stock in Maxxam. So far, 19 California labor unions have contacted CalPERS (California Public Employees Retirement System) board members asking them to support a debt-for-nature settlement of the OTS and FDIC lawsuits. Fourteen of these have taken it one step further, asking CalPERS to sell all of its Maxxam stock (if Maxxam refuses debt-for-nature). The Rose Foundation is now seeking shareholders of other funds holding Maxxam stock to sponsor shareholder resolutions to do the same. The following is a partial listing of the funds with Maxxam holdings...

- New York State Common Trust Fund (the public employee's retirement system) - New York City Public Employee Retirement Funds - Pennsylvania Public Schools Retirement System - Ohio Public Employees Retirement System - Colorado Public Employee Retirement Administration - Aid Association for Lutherans (the Lutheran Pension Fund)

WEEKLY FEATURE: HEADWATERS GROVE DESCRIPTION

ALL SPECIES GROVE AND RESIDUALS, including Booths Run and Road 12 Lawrence Creek (approximately 832 acres) This area encompasses Lawrence, Bell, and Booths Run Creeks and ranges between 1,250 and 2,000 feet in elevation. It is composed of two main areas. The first and largest intact element of the grove lies along Lawrence Creek, to the east, and up the Bell Creek watershed. A significant stand of Douglas fir old-growth is found on the north-facing slopes of Booths Run. All of these areas are either contiguous or connected through residual corridors. The area within the Bell Creek drainage is currently threatened by a proposed Timber Harvest Plan, THP 1-97-188 HUM. All Species Grove is located in a migration corridor from the Headwaters Forest to the old-growth forests and rock outcroppings of the BLM's Iaqua Buttes, which rim the greater Lawrence-Yager Creek watershed. The stream side and upland vegetation is also unique in this area, including western red cedar, hemlock, California bay laurel, and madrone along with the ancient redwood and Douglas fir.

---> Provisions specific to authorization of the Headwaters Forest appropriation could further weaken the Habitat Conservation Planning process, resulting in further damage to ancient redwood forests and dependent wildlife, including endangered and threatened species.

---> Provisions requiring Congress to specifically authorize Land and Water Conservation Fund expenditures will impede future land acquisitions through a cynical and potentially destructive bargaining process similar to the one surrounding this year's Interior bill.

---> The rider calling for elimination of caps on Purchaser Road Credits will continue an environmentally destructive and fiscally irresponsible subsidy of corporate road-building in our publicly-owned National Forests.

---> The rider postponing management reforms to address grazing-related environmental damage on National Forest lands will allow continued degradation of watershed stability, water quality, and aquatic ecosystems throughout the Southwest.
