The mythical "republican barrier" on the far right has long since
exploded and the RN is proclaiming an "ideological victory". Beyond the
symbolic aspect, this project would have very concretely constituted a
serious deterioration of the rights and living conditions of hundreds of
thousands of French people and foreigners in the country. ---- The law
amended by the Senate adopted the principle of "national preference" of
the RN. The inability to obtain access to social benefits would have
plunged tens of thousands of already isolated families and individuals
into poverty.
The questioning of land law and the prospect of dual nationals
potentially being deprived of their nationality confirmed an inequality
of rights between citizens depending on their origin.
This law led to the criminalization of undocumented immigrants and
foreigners: offense of irregularity, expulsions for "disturbing public
order" or "non-respect of the values of the Republic", imposition of an
expulsion bond on non-European students. Humiliating measures exposing
foreigners to the arbitrariness of justice and the police while
effectively placing their supporters as accomplices to crimes.
More and more obstacles were placed in the way of visa applicants:
systematization of OQTF for people rejected from asylum and ITF
(Prohibition from French territory) for those found guilty of crimes,
restriction of family reunification and justice made ever more hastily
in the examination of asylum applications.
Continue the mobilization
The mobilization against this law was launched more than a year ago by
collectives of undocumented immigrants, union sections of undocumented
workers, associations and the Marche des Solidarités.
Since October, mobilization has increased. More than 400 organizations
opposed to the project brought together tens of thousands of people
across the country. The national demonstrations of January 14 and 21
further demonstrated the increase in mobilization against the project.
Certain sectors, particularly education and health, have filed notices
of strikes, which had already broken out last October on Olympic sites
employing undocumented workers.
The decisions of the Constitutional Council are far from having buried
the movement and new national mobilizations should continue from February 3.
Censorship far from sufficient
The censored measures cited were for formal defects rather than for
their racist nature. Nothing says that these measures will not be
proposed again to the Assembly in the months to come. Worse, several of
the worst measures have been retained: loss of nationality, end of
collegiality in the examination of asylum applications, non-issuance or
renewal of the residence permit in the event of "non-compliance with the
principles of the Republic" , systematization of OQTFs for rejected
asylum seekers and ITFs for people found guilty of crimes.
We could not count on a reactionary institution to protect us from
fascism. It is in our places of life, work, study and in the streets
that a real anti-racist force will be able to oppose the destruction of
land rights, asylum and the creation of undocumented immigrants. .
