Saturday May 28th members of the activist community gathered at Riverpark
in Fresno around 6pm for Infoshop. Before the action even started members
of the collective were greeted by security enforcing the "no sitting on
the ground" rule. The security guards were already giving the collective
members the look that says "Looks like you're up to no good".
After a space was selected, just to the right of the theater, the
collective members started to set up shop. Before the set-up was
complete Two security guards again approached and told the
activists that they could not hand out literature there. The reason
for this was that they were on private property. Activist fought back
against the security guards citing the Pruneyard decision and First
Amendment rights. This back and forth argument went on for a
few minutes. When security realized that the collective would not
leave so easily the police were called. By this time there were six
security guards present.
After a long wait the a police officer arrived, looking and sounding
like he just came from the academy, he seemed uneasy and was
flustered when he spoke. The Officer Acted more like a moderator
than a policeman saying that he wanted an agreement to be made
between the activists and security. The activist wanted to stay
because security could not provide them with a reasonable time
and place to do the infoshop. The security guards wanted the
activists to leave for the same reason. When an agreement could
not be made the Officer said he was leaving and he would be back.
At about 7:40pm the security guards approached the activists citing
a no loitering law and said if they didn't leave they would be
arrested for trespassing. The collective talked it over and came to a
consensus that they would leave, but will do research on those laws
the security used to kick them out of a public place.
