JUSTICE FOR TOMEK WILKOSZEWSKI!!!
Being a victim of brutal assaults, Tomasz Wilkoszewski was severely
punished with a 15 years imprisonment sentence. Such severe punishment is
not used even in cases of the members of mafia or merciless criminals. Tomek
has been in prison for 58 months because he isn't rich, he doesn't have
contacts with authorities and cannot afford a lawyer. His only guilt was
that he was 'different' and defended himself.
Tomasz Wilkoszewski at the end of February, 1997 was sentenced to 15 years
of imprisonment in Piotrków Trybunalski. He was found guilty of murdering
the 17-year old neo-fascist - Daniel Świtoń. Tomek comes from a small
village called Brudzice situated in the vicinity of Radomsko. He was a
diligent student who was planning to study at the university. Till March
1996 he was not found guilty of any offence.
In Radomsko (a typical small town in central Poland) the group of nazis was
terrorizing all youngsters in this town. Assaults were common and they took
place with the police and the town authorities being totally passive. People
who did not fit the stereotypes adopted by the nazis were attacked. Tomek
was a regular victim of those attacks (once the muggers wanted to gouge his
eyes out). Every case reported to the police was ignored. The follow-up was
the natural consequence of the prior events; since the youngsters could only
depend on themselves, they decided to defend themselves by their own means.
As a consequence, the young fellow was killed. Tomek was the accused. The
police wanted to find the culprit so much that they did not investigate the
proofs carefully. Till the present day they have not found out whether the
knife located at Tomek's place was used during the crime. Furthermore, on
the place of the murder another knife was found. The police was not even
sure which knife was used. These doubts should have been used for the
benefit of the accused. But the further explanations did not take place and
the court could not even figure out the state of affairs during the murder
and the sentence was based on suppositions. The court did not accept the
extenuating circumstances (Aggression of Tomek and his friends was the
result of the long-term persecution and lack of help from the police). The
sentence of the 15-year imprisonment and the severe conditions are more
oppressive that those given by the Polish courts. The court ostensibly acted
on the spur of the moment (influenced by the so-called "Black Marches"
organized to protest against violence). Support and help for Tomek and his
family is organized both in Poland and abroad. Thanks to the campaign
organized by the Anarchist Black Cross and the Anarchistic Federation it was
possible to collect several thousand zlotys for the help in court. Help from
many people resulted in moving Tomek to another prison where he could
continue his education. Now, ABC is preparing to send him a PC set (we are
facing problems with collecting money for a parcel).
Unfortunately, for the time being Tomek is still in prison. Thousands of
signatures under the support letters prove to be of little help. The
cancellation trial at the supreme court failed to change the sentence. Now
he may only be pardoned by the president.

KLAUDIUSZ DOES TIME.
Another case is the one of Klaudiusz Gliklich, who comes from Pszczyna. In
November 1991, being attacked by three skinheads he efficiently defended
himself. In the result, two of the aggressors received injuries. Afterwards
Klaudiusz was stopped and arrested by the police. As a result of false
depositions of the skinheads he was charged with mugging and sentenced to
six years in prison. After serving 2 years and 9 months of the sentence he
was released on parole. He was given supervision of the curator for the
conditionally released person who turned out to be a fomer nationalist from
Pszczyna. He was making Klaudiusz's life hard as much as he could.
Eventually, being provoked by the curator, Klaudiusz hit him. In May 1997
his parole was cancelled and Klaudiusz returned to prison for the rest of
his sentence. Since then he remains in prison and since December is in
hospital due to the health problems.

FRAMED BY THE POLICE
Jarek 'Śruba' is a punk from Wroclaw, who in November 1999 was sentenced to
three years and six months of imprisonment. On basis of proofs falsified by
the police and fake witnesses he was charged with beating and robbing a
policeman.

on 27 December 2000 were detained and arrested for three months after having
a fight with neo-nazis. They were charged with beating of one of the nazis.
During their stay under arrest one of them was severely beaten by other
prisoners.

ANTI - HIGHWAY CAMPAIGN
On the 15th of May, 2000, Damian Kaczmarek (Anarchist Federation Poznań) was
sentenced to eight months of restriction of liberty (8 months of work for
public purposes 30 hours a month) and paying 400 zlotys of costs of court
proceedings. He was charged with using violence against security guards, who
were attacking a building occupied by the anarchists and ecologists. The
building was to be taken down to make place for the A4 highway, planned to
run through Góra Św. Anny. The security guards were hired by the German
company Ilbau Kirchner to brutally break the anti highway protests of
anarchists and ecologists.
On 11 May, 2000 a group of three anarchists from the Anarchist Federation
Poznań entered the office of the Highway Building and Exploitation Agency in
Poznań and occupied it for an hour. They demanded the acquittal of Damian
Kaczmarek and withdrawal of the agency from the program of building highways
in Poland. They were arrested by the police and taken to the police station.
On the 26th of June, the misdemeanor court sentenced them to a month of work
for public purposes, 20 hours a month and paying the costs of legal
proceedings (12zl)
FINED FOR 1 MAY 1999
Rafał Górski (Anarchist Federation Kraków) was fined 560 zlotys for the
participation in an illegal gathering and the possession of a dangerous
object.
GODIVA HAS TO PAY.
A model that played the leading role in the anti-tax hapenning "Lady Godiva"
in Kraków was fined 100 zł.
CAKE THROWS
A legal proceeding is under way against A. Smosarski ( Leftist Alternative)
who attacked the former minister of the finances, Leszek Balcerowicz
throwing a cake and Brussels sprouts at him.
On 19 January 2001 a cake reached the face of the prime minister, Jerzy
Buzek during his meeting in Wrocław. In result two anarchists got arrested
and taken to the police station. There, in appalling conditions they were
interrogated. They were accused of insult and violation of immunity of a
government official. They may receive even 3 years of imprisonment. A legal
proceeding in their case is under way.
OCCUPATION OF THE SUBPREFECT'S OFFICE
People who occupied the subprefect's office in order to protest against
breaking workers' rights in the Labour Office of the Province were fined by
the misdemeanor court, respectively: Mirosław Postawa, the labour inspector,
200 zł, Rafał Górski (Anarchist Federation Kraków) 560 zł and Piotr Uziel
(Anarchist Federation Kraków) 200 zł.
"KORMORAN" RALLY
The misdemeanor court in Giżycko found guilty the ecologists who blocked the
route of the "Kormoran" car rally in July 2000. The route was situated in
the area of natural environment of cormorants. Owing to the effective
defence they were only orally admonished.
THE FREE CAUCASUS COMMITEE - POZNAŃ
Cases concerning the Free Caucasus Commitee, a group of people acting in aid
of the independence of Chechnya:
The legal proceedings are under way against five members of the Free
Caucasus Committee who entered the area of the Russian Consulate in Poznań
on the 23rd of February during a protest against war in Chechnya. They
painted the building of the consulate in anti-war slogans, destroyed the
Russian emblem, destroyed the Russian flag and pulled up the Chechnyan flag
on its place. They have been accused of destroying the property of a
considerable value (over 5 thousand zlotys), encroachment on territory and
insulting Russian national symbols. The proceeding was passed from the
Disrict Court to Court of Appeal and back. Eventually the trial is to be
appointed in the District Court.

On 23 November, 2000 the Disrict Court in Poznań sentenced Maciej Roszak, a
member of the Free Caucasus Committee to six months of imprisonment, the
carrying out of the sentence being stayed for three years and fined him 524
zł on behalf of the Russian Consulate and costs of court proceedings (100
zł) for painting the information plate of the Russian Consulate during the
anti-war protest in December 1999. The losses were estimated on 2600 zł.
Two members of the Free Caucasus Committee were fined 450 zł for littering
the pavement with an egg shell, which was thrown at the police.
On 12 October the misdemeanor court fined a member of the Free Caucasus
Committee with an incommensurably high fine of 3500 zł for spilling
watercolour before the gate of the Russian Consulate. It was raining then
and after a few hours there wasn't any sign of it left.
POLICE ATTACK A SQUAT IN WROCŁAW.
In May 2000 in Wrocław there were rumours that an attack was being prepared
by skinheads on a squat in Kromera Street. The squatters prepared for the
defence and waited. At night indeed the attackers arrived. However, they
turned out not to be skinheads but policemen in sweat suits. In explicit
words they demanded opening the doors. Eventually, coming through a window
they entered the squat and started the beating, instead of truncheons using
table legs. The situation calmed down after the regular policemen in
uniforms arrived. The squatters' identity was written down and one of them
was detained. The police bandits in sweat suits were recognized as the ones
that previously had been involved in attacks on the former squat in
Wrocław - "Rejon 69." The action was brought against the behaviour of the
police.
We still help all imprisoned, but we can't afford on such level of help
they deserve - we are lack of money!
